China's Regulations on Customs Protection of Intellectual Property Rights defines that the customs protects the exclusive right to use trademarks, Copyrights, copyright-related rights and patent rights related to import and export goods and protected by laws and administrative regulations of the People's Republic of China.

The scope of application of customs protection of intellectual property rights in China: intellectual property rights related to import and export goods and protected by laws and administrative regulations of the People's Republic of China, including exclusive right to use trademarks, copyright, copyright-related rights and patent rights;  At the same time, the import and export of goods that infringe on intellectual property rights protected by laws and administrative regulations is prohibited.



Limitation of customs protection record for intellectual property rights:



(1) Validity period of filing



The archival record of customs protection of intellectual property rights shall take effect from the date of approval of the Archival record by the General Administration of Customs and shall be valid for 10 years.  If the term of validity of the intellectual property right is less than 10 years from the effective date of the archival filing, the term of validity of the archival filing shall prevail.



(2) Renew the validity period of filing



The holder of intellectual property rights may, within 6 months prior to the expiration of the term of archival filing for the customs protection of intellectual property rights, apply to the General Administration of Customs for the renewal of archival filing in writing with the attached documents.



The General Administration of Customs shall, within 10 working days from the date of receiving all the application documents for renewal, make a decision on whether to grant renewal and notify the intellectual property right holder in writing.  If it is not renewed, the reasons will be explained.



The term of validity for renewal of archival filing shall be 10 years starting from the next day after the expiration of the previous archival filing.  If the validity of the intellectual property is less than 10 years from the next day after the validity of the previous archival filing, the validity of the renewed archival filing shall be subject to the validity of the intellectual property.
